PaintQuote AI is operated by Rico Schurter, an individual based in Switzerland, not currently incorporated as a separate legal entity, with operating address at Via alle Vigne 6, 6598 Tenero, Switzerland. The operator is a natural person; no corporate or LLC entity is involved in providing the Service. Throughout these Terms, “PaintQuote AI”, “we”, “us”, and “our” refer to Rico Schurter operating under that trade name.
Business use only. The Service is a business-to-business tool intended exclusively for licensed painting contractors and their businesses. You represent and warrant that you are using the Service solely for business and commercial purposes in the operation of your painting-contractor trade, and not as a consumer for personal, family, or household purposes. You are at least 18 years old and authorized to enter into contracts on behalf of your business.
PaintQuote AI is a software tool that helps painting contractors create professional estimates using voice recording and AI technology. The service includes estimate generation, client communication, digital signatures, invoicing, and payment collection.
IMPORTANT — Your estimates are YOUR professional judgment:
You acknowledge that PaintQuote AI uses automated speech-to-text (OpenAI Whisper) and large language model extraction (Anthropic Claude) which can produce errors including but not limited to misheard numbers, misattributed surfaces, missing measurements, or incorrect units. You agree that before sending any estimate, you will:
Failure to perform these steps does not reduce the finality of estimates you send to clients. You bear full responsibility for pricing accuracy once sent.
Do NOT rely on AI suggestions without verification. Always review, correct, and approve before sending.
You are solely responsible for maintaining proper licensing, permits, and insurance in your jurisdiction. PaintQuote AI does not:
You represent and warrant that you maintain all required licenses, permits, general liability insurance, and workers' compensation coverage for your jurisdiction. The license number displayed on your estimates is provided by you and not independently verified.
You warrant that your contractor license number, if provided, is genuine, current, and valid in the state where work is performed. Providing false or expired license information is grounds for immediate account termination and may constitute fraud under state contractor-licensing statutes. We may suspend or terminate accounts when license issues come to our attention through user reports, law enforcement requests, or our own review.
PaintQuote AI is a software tool, not a law firm, accounting firm, or compliance service. Any contract language, disclosures, or templates the Service generates or includes — including but not limited to home-improvement contract clauses, cancellation/rescission notices, license-display fields, or tax line items — are provided for your convenience as informational defaults only. They do not constitute legal, tax, insurance, or regulatory advice, and may not be complete or correct for your jurisdiction or your specific transaction.
You are solely responsible for ensuring that every estimate, contract, invoice, disclosure, and notice you send to a client complies with all applicable federal, state, and local laws, including consumer-protection, home-improvement-contract, licensing, and tax requirements. You should consult a licensed attorney and a tax professional in your jurisdiction before relying on any document produced through the Service. PaintQuote AI disclaims all liability arising from your reliance on Service-generated text without independent professional verification.
Digital signatures collected through PaintQuote AI comply with the Electronic Signatures in Global and National Commerce Act (E-SIGN Act, 15 USC §7001). By using the signature feature:
Paper alternative and withdrawal of consent. You may request a paper copy of any document signed electronically through PaintQuote AI by emailing the painter directly using the contact information shown on the estimate. Choosing paper does not affect the validity of an electronically-signed agreement nor any rights or obligations under it (E-SIGN Act §7001(c)(1)(C)). You may withdraw your consent to receive electronic records at any time by emailing us at support@paintquote.ai; withdrawal applies to future communications and does not invalidate previously-signed documents.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE AGGREGATE LIABILITY OF PAINTQUOTE AI FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE SHALL NOT EXCEED (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) FIFTY U.S. DOLLARS, WHICHEVER IS GREATER.

WE DO NOT WARRANT THAT AI-EXTRACTED MEASUREMENTS, QUANTITIES, OR TRANSCRIPTS WILL BE ACCURATE. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR THAT DEFECTS WILL BE CORRECTED. TO THE EXTENT MANDATORY LAW PROVIDES NON-DISCLAIMABLE WARRANTIES, THIS SECTION APPLIES TO THE MAXIMUM EXTENT PERMITTED.
You own all data you create in PaintQuote AI — estimates, invoices, client records, audio recordings, and pricing data. We do not claim ownership of your content.
PaintQuote AI's proprietary materials — including pre-populated line item database, coverage rates, production rate calibrations, extraction prompts, and AI system instructions — remain our intellectual property and are not “Your Content”. Your data export includes only content you personally entered, generated, or caused to be generated through normal use (your estimates, invoices, clients, transcripts, recordings). Reverse-engineering or redistributing the seed database is a material breach.
You agree not to use PaintQuote AI to:
When sending emails to your clients through the platform, you agree that:
The voice-recording feature captures audio at a job site. You are solely responsible for compliance with federal (18 USC §2511) and state wiretap / eavesdropping laws. In CA, CT, FL, IL, MA, MD, ME, MI, MT, NH, NV, OR, PA, VT, WA and other all-party-consent states, you must verbally inform every person whose voice may be captured before starting a recording and obtain their agreement. Our UI requires you to attest this before each recording, but the legal obligation is yours. You agree to indemnify PaintQuote AI against any claim, action, investigation, or penalty arising from your failure to obtain the required consents.
Illinois contractors also agree: (a) to verbally announce recording to all persons present before starting, including a statement that no biometric identifier will be extracted; (b) to confirm in the recorder UI that no minor under 13 is present or will be captured; (c) that while PaintQuote AI does not extract voiceprints, diarization, or speaker-ID and therefore believes the recording falls outside 740 ILCS 14, you bear sole responsibility for BIPA compliance and will indemnify us for any BIPA claim arising from your recordings.

Notices should include the elements described in 17 USC §512(c)(3). We operate a good-faith review process and a repeat-infringer policy: accounts with multiple substantiated notices are terminated.
You grant PaintQuote AI a worldwide, non-exclusive, royalty-free license to host, store, transmit, format-convert for rendering, index for search, and process Your Content solely to the extent technically necessary to provide the Service, including transmission to our subprocessors. This license does not include the right to modify substantively, create derivative works, or publicly display Your Content outside the Service. This license terminates when you delete the content or your account, except where we must retain it for legal obligations (E-SIGN §7001(d) 7-year retention, tax record-keeping, security audit, defense of legal claims).
You may terminate your account at any time via Settings → Danger Zone. We may suspend or terminate accounts for material breach with 14 days' notice and opportunity to cure, except for fraud, illegal activity, or repeated DMCA violations where termination is immediate. On any termination you have 30 daysto export your data via Settings → Privacy & Data before records are purged (except legally-required retention — signed estimates, invoice history — which are preserved).
“Material breach” includes but is not limited to:
PaintQuote AI integrates with Stripe Connect to enable painters to accept online payments from their customers. The customer is contracting with the painter, not with PaintQuote AI. PaintQuote AI provides the software interface; Stripe processes the payment.
By using PaintQuote AI's payment features:
When you accept payment from a client through PaintQuote AI, you are the merchant of record. Stripe processes the charge directly into your connected account (Direct Charges), and Stripe fees are deducted from your payout. PaintQuote AI is the platform — we never hold, touch, or have custody of your funds. If a client disputes a charge with their bank (chargeback) or files a dispute with Stripe, the dispute is filed against your Stripe connected account, not PaintQuote AI. You are responsible for responding to the dispute through your Stripe Dashboard. PaintQuote AI will, on request, provide you with the signed estimate, the cryptographic snapshot hash, and the audit trail (IP address, timestamp, user agent of the signer) as evidence to submit to Stripe. If a dispute is decided against you, the disputed amount and any Stripe dispute fee are debited from your connected account balance, not from PaintQuote AI.
You agree to indemnify, defend, and hold harmless PaintQuote AI, its officers, directors, and employees from any claims, damages, losses, or expenses arising from:
The indemnification obligations above are subject to any mandatory consumer-protection laws in your jurisdiction that limit the enforceability of indemnification clauses (e.g., California Civil Code §1668). We do not enforce indemnification where doing so would violate your non-waivable statutory rights.
PaintQuote AI is not liable for any failure or delay in performing our obligations where such failure or delay results from causes beyond our reasonable control, including but not limited to: natural disasters, acts of government, internet outages, third-party service failures (including OpenAI, Stripe, Supabase), cyberattacks, pandemics, or labor disputes.
During a force majeure event, our obligations are suspended. We will notify you promptly and take reasonable steps to mitigate the impact.
Payment obligations are not suspended by force majeure events. All other obligations may be temporarily suspended for the duration of the event, after which the affected party will resume performance as soon as reasonably practicable.
Informal Resolution First. Before filing any formal claim, you agree to contact us at support@paintquote.ai and attempt to resolve the dispute informally. We commit to respond within 15 business days and will work in good faith to reach a resolution within 30 days.
Small Claims. Either party may bring an individual action in small claims court for eligible claims (typically under $25,000 USD or equivalent) in your place of residence, provided the claim does not exceed small claims jurisdictional limits.
Binding Arbitration for Other Claims.EXCEPT for small claims matters and claims for injunctive relief (which may go to court), any dispute, claim, or controversy arising out of or relating to these Terms or the Service that is not resolved informally within 30 days will be finally resolved by binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Commercial Arbitration Rules. Arbitration will be seated in Delaware, USA (unless parties agree otherwise), and conducted in English. The arbitrator's decision will be final and enforceable in any court of competent jurisdiction.
Class Action Waiver. ALL CLAIMS MUST BE BROUGHT ON AN INDIVIDUAL BASIS, NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE CLAIMS OF MORE THAN ONE PERSON AND MAY NOT PRESIDE OVER ANY FORM OF REPRESENTATIVE OR CLASS PROCEEDING.
Opt-Out Right. You may opt out of binding arbitration by sending written notice to support@paintquote.ai within 30 days of first accepting these Terms. Opt-out does not affect any other provision of these Terms.
Injunctive Relief. Either party may seek injunctive relief in any court of competent jurisdiction to protect intellectual-property rights or to prevent ongoing harm, without first exhausting informal resolution.
Severability of Waivers. If the class action waiver or individual arbitration requirement is found unenforceable for a specific claim under applicable law, that claim may proceed on its original basis in a court of competent jurisdiction while the rest of this section remains in force for all other claims.
These Terms are governed by the substantive laws of Switzerland without regard to conflict-of-law principles and excluding the UN Convention on Contracts for the International Sale of Goods (CISG), EXCEPT that for claims brought in US small claims courts or US arbitration under §19, the substantive law of your US state of residence applies.
Exclusive forum for litigation not subject to arbitration is Bellinzona, Canton of Ticino, Switzerland, EXCEPT as provided in §19 (small claims, arbitration, injunctive relief in any court of competent jurisdiction).
Mandatory consumer / sector laws.Nothing in these Terms waives any consumer-protection rights or other mandatory statutory protections available to you in your country or state of residence. United States federal statutes specifically applicable to the service — including the E-SIGN Act (15 USC §7001) and the CAN-SPAM Act (15 USC §7701 et seq.) — and state laws such as the California Consumer Privacy Act (CCPA/CPRA), Illinois BIPA (740 ILCS 14), and state auto-renewal statutes apply to relevant parts of the service regardless of this choice of law.
The PaintQuote AI website may reference trademarks owned by third parties (including but not limited to PaintScout®, Jobber®, DripJobs®, and QuoteIQ®) for the sole purpose of identification and factual product comparison under the doctrine of nominative fair use. Such references do not imply affiliation with, endorsement by, or sponsorship by the respective trademark owners. All trademarks are the property of their respective holders.
We may update these Terms from time to time. We will notify you of material changes via email at least 30 days before they take effect. On material changes you will be prompted to re-accept on next login, and the new version number + date will appear at the top of this page.
If you do not accept material changes, you may cancel your account within 30 days of the change taking effect and receive a pro-rata refund of the unused portion of any prepaid annual subscription fee. Continued use of the Service after the effective date of a change constitutes acceptance of the revised Terms.
The following sections survive any termination or expiration of these Terms and your account: §3 (AI Disclaimer), §4 and §4A (Licensing; No Advice), §7 (Limitation of Liability), §8 (Warranty Disclaimer), §9 (Data Ownership), §12 (Wiretap/Recording), §14 (Content License, to the extent of legally-required retention), §17 (Indemnification), §19 (Dispute Resolution), §20 (Governing Law), and any provision that by its nature should survive.
Right to Cancel.Estimates signed at the homeowner's residence or a location other than the contractor's permanent place of business qualify as home solicitation sales under 16 CFR §429 (FTC Cooling-Off Rule) and analogous state statutes. Clients have a 3-business-day right to cancel without penalty after signing. This right is displayed on every signature page as required. If a client cancels within 3 business days, any deposit paid must be returned within 10 business days.
The Service integrates with Stripe, Inc. for subscription payments (what you pay us) and for client-to-contractor payments (what clients pay you through estimates and invoices). Stripe processing fees — typically 2.9% + $0.30 per card transaction and 0.8% (capped at $5) for ACH — are deducted by Stripe from each client payment. PaintQuote AI does not collect these fees on top of its subscription price. Stripe's Services Agreement governs all payment processing; by enabling online payments you agree to Stripe's terms at https://stripe.com/legal/ssa.
